Terms of Use — End Customer

Preamble

These Terms of Use (the « Terms ») govern the use by any end user (« You » or « User ») of the features offered by the Suzzy platform when you interact with a partner restaurant (the « Restaurant »).

Suzzy's role

Suzzy is the publisher of a technical SaaS platform allowing Restaurants to manage their digital services (reservations, loyalty program, games, review collection). Suzzy is neither the seller nor the provider of the products and services offered by the Restaurant and does not intervene in the commercial relationship between You and the Restaurant.

Whom do you contract with?

When you make a reservation, play a game, sign up for a loyalty program or leave a review, you contract directly with the Restaurant, not with Suzzy. Suzzy provides only the technical tools enabling this interaction.

1. Definitions

Platform

Refers to the web and mobile application published by Suzzy enabling Users to interact with partner Restaurants.

Publisher (Suzzy)

Refers to SUZZY, SAS with share capital of €3,000, RCS Paris 102 900 487, 47 rue Vivienne, 75002 Paris, France.

Restaurant

Refers to any restaurant, café, bar or similar establishment that has subscribed to a Suzzy subscription and uses the Platform to offer its services to its customers.

User

Refers to any adult natural person using the Platform to interact with a Restaurant, whether or not they hold an account.

Services

Refers to all features described in Article 3 below.

2. Acceptance

Use of the Platform implies full acceptance of these Terms. By using the Platform (notably by making a reservation, participating in a game or signing up for a loyalty program), you acknowledge having read, understood and accepted these Terms. If you do not accept these Terms, you must stop using the Platform.

3. Description of Services

The Platform allows you to access the following features with partner Restaurants:

3.1 Digital menu viewing

Viewing of a Restaurant's menu via QR code or direct link, with access to items, prices, photos, allergens and nutritional information provided by the Restaurant.

3.2 Online reservations

Booking a table at a Restaurant, on the date and time of your choice, subject to availability offered by the Restaurant.

3.3 Loyalty program

Enrollment in a Restaurant's loyalty program, accumulation of points, access to rewards and storage of a dematerialized loyalty card in Apple Wallet or Google Wallet.

3.4 Promotional games

Participation in promotional games offered by Restaurants (wheel of fortune, scratch, slot machine, dice, flip-card), without any obligation to purchase.

3.5 Review submission and viewing

Submission of reviews and ratings on a Restaurant, viewing of reviews published by other Users and, where applicable, integration of reviews published on third-party platforms (Google, TripAdvisor, Facebook).

4. Reservations

4.1 Making a reservation

Any reservation made via the Platform constitutes a direct commitment between You and the Restaurant. Suzzy does not intervene in the formation, execution or resolution of this commitment. The Restaurant may confirm your reservation by email or SMS.

4.2 Modification

Any modification request (party size, date, time) must be made directly to the Restaurant or through the Platform under the conditions defined by the Restaurant.

4.3 Cancellation

You may cancel a reservation from the Platform or by contacting the Restaurant directly. Cancellation conditions (notably timeframes and any penalties) are defined by each Restaurant and may vary.

4.4 No-show

In case of unsignaled absence from a confirmed reservation, the Restaurant may, in accordance with its own policy, refuse subsequent reservations or require a guarantee. Suzzy records absences declared by Restaurants for customer relationship management, in accordance with our Privacy Policy.

5. Loyalty program

5.1 Enrollment

Enrollment in a Restaurant's loyalty program is free and optional. It requires the disclosure of at least one identification item (email or phone number).

5.2 Dematerialized loyalty card

You may add your loyalty card to Apple Wallet or Google Wallet. The use of these services is governed by their respective publishers.

5.3 Earning points

Point-earning conditions (per visit, per euro spent, multiplier by tier) are defined by each Restaurant. Points do not constitute legal tender and have no value outside the relevant Restaurant's loyalty program.

5.4 Rewards

Rewards are granted under conditions defined by each Restaurant. The Restaurant may modify its rewards, tiers or usage conditions at any time, subject to reasonable prior notice.

5.5 Validity period

Points and rewards may be subject to a validity period defined by the Restaurant. Beyond this period, they may be considered expired without compensation.

5.6 Program discontinuation

If the Restaurant discontinues its loyalty program or terminates its Subscription, accumulated points may be lost without compensation. Suzzy cannot be held liable for such loss.

6. Promotional games

6.1 No purchase necessary

Games offered on the Platform are organized with no purchase necessary and no financial contribution from the participant. No fee may be required to participate.

6.2 Rules

Each game is governed by its own rules established by the Restaurant, accessible before participation. Participation in the game constitutes full acceptance of the applicable rules.

6.3 Winner designation

Winners are designated according to the methods specified in the rules (drawing, pure chance, etc.). Results are final.

6.4 Rewards

Rewards won in a game cannot be refunded in cash and are neither transferable nor exchangeable. Their validity period is specified in the game rules.

7. Review submission

7.1 Honesty and good faith

You agree to submit only sincere, verified reviews based on personal and real experience at the relevant Restaurant. Any fraudulent, defamatory, abusive, racist or privacy-infringing review is strictly prohibited and may be removed without notice.

7.2 Moderation

In accordance with French Decree No. 2017-1436 of September 29, 2017 on online reviews:
  • published reviews are not subject to systematic prior control;
  • any review may be reported by emailing [email protected] or directly from the Platform;
  • the date of submission is publicly visible.

7.3 Incentivized reviews

When a review is solicited as part of a game or loyalty program offering a reward in return, this incentivized nature is explicitly indicated on the published review, in accordance with the French Consumer Code. The reward is granted regardless of the positive or negative nature of the review.

8. Personal data

Processing of your personal data is governed by our Privacy Policy. You have the right to access, rectify, delete, restrict, transfer and object to the processing of your data at any time. To exercise these rights, contact us at [email protected]. In case of unresolved disagreement, you may lodge a complaint with the French Data Protection Authority CNILwww.cnil.fr.

9. Intellectual property

All elements of the Platform (interfaces, brands, logos, texts, images, features) are protected by intellectual property law and remain the exclusive property of Suzzy or its partners. Any reproduction, dissemination or exploitation, even partial, without prior written authorization is prohibited. Restaurant trade names, logos and photos remain the property of said Restaurants.

10. Liability

Suzzy cannot be held liable for the Restaurant's failures regarding its own obligations (quality, hygiene, food safety, accuracy of displayed information, reservation compliance, etc.). For disputes regarding an experience at a Restaurant, you must contact the relevant Restaurant directly. Suzzy uses best efforts to ensure technical Platform quality but cannot guarantee absolute availability or absence of error.

11. Consumer mediation

In accordance with articles L611-1 et seq. and R152-1 et seq. of the French Consumer Code, you may seek free of charge a consumer mediator to amicably resolve any dispute:

12. Modification of the Terms

Suzzy reserves the right to modify these Terms at any time. The current version is accessible at suzzyapp.com/en/terms-client. Changes take effect upon publication.

13. Governing law and jurisdiction

These Terms are governed by French law. In case of dispute, and in accordance with article R631-3 of the French Consumer Code, the territorially competent jurisdiction is, at the User's choice, that of the place where they resided at the time of contract formation or occurrence of the harmful event. The French version of these Terms is the legally binding version in case of discrepancy.
